Family takes legal action over what they claim was “senseless torture”

Legal action is being taken in Texas, in the US, on behalf of a family who claim that their mother was subjected to “senseless torture … for over 10 days” and the healthcare providers failed to act in accordance with her advance care directive.  Read more …

There are two important points here:

  • Those who claim all end of life pain and suffering can be relieved, and is being relieved, are either wilfully ignorant, in denial or are telling bare-faced lies.
  • It’s very important for everyone to have an advance care directive and, if possible, to appoint an enduring guardian.  (For advice and assistance have a look at the very helpful guide to end of life planning.) But as this story shows, that is sometimes not enough.

We recognise that there are differences in the law between Tasmania and Texas, but will keep track of the legal action because it represents such important principles about people’s rights to express their wishes and have them respected.
